Introduction 

 

Gina Tricot UK Ltd, hereinafter referred to as “ginatricot” or “We”, is a retail clothing company and fashion brand for women with its roots in Sweden. 

  

The following terms & conditions apply to all orders placed by private individuals in the United Kingdom at ginatricot.com/uk. By placing an order, the customer accepts these terms & conditions. These terms do not affect your statutory rights as a consumer under UK law. We do not accept orders from businesses through our website. 

 

These terms & conditions are reviewed regularly, and customers are recommended to read them at the time of each purchase. The terms & conditions applicable to a specific order are those in effect at the time the order is placed.  

 

Prices and delivery fees 

 

All prices are shown in British pounds (£) and include UK VAT. The prices displayed on the website include the statutory value added tax, but do not include delivery cost. In the checkout view, the total cost for your purchase including delivery cost will be displayed. 

 

A delivery cost of £4.90 applies to all orders, free delivery is available on orders over £70 (VAT and duties included).  

 

Age and residential requirements 

 

To place an order at ginatricot.com/uk, you must be at least 18 years old and not be under guardianship. We deliver to valid addresses in Great Britain only (England, Scotland and Wales), excluding Northern Ireland, the Channel Islands, BFPO addresses and mail forwarding companies. 

 

If you are resident outside the UK, please visit ginatricot.com to be directed to your ginatricot site. 

 

Purchase 

 

A binding contract between you and ginatricot is formed when you receive the order confirmation by email. This is conditional on you providing correct details, including email address, delivery address and phone number. 

 

The purchase amount is charged when the order is dispatched. If you pay by card, the purchase amount is reserved on your card when the order is placed. 

 

If a delivery cannot be completed because items are out of stock, this will be indicated in the delivery confirmation, where the products are marked as not delivered. 

 

ginatricot reserves the right to refuse or cancel orders where there is a reasonable suspicion of fraud, where stated terms are not met, or where a customer's purchase and return history, assessed individually after being identified by our system, indicates that continued purchases are not commercially viable. Affected customers will be notified and may contact our customer service department to discuss the decision. 

 

Payment 

 

We accept payment by credit cards Visa and Mastercard and Klarna via Kustom Checkout. If Klarna via Kustom Checkout is used for payment services, Kustom’s terms and conditions shall apply https://www.kustom.co/legal/general-terms-and-conditions. 

 

Security of payments 

 

All card transactions are encrypted using SSL (Secure Socket Layer). We verify card validity and that sufficient funds are available to cover the purchase. ginatricot reserves the right to refuse a card purchase where there is a reasonable suspicion of fraud or where the card is invalid. We use an authorised payment provider that handles your card details securely. ginatricot does not store your card details. Delivery 

 

Deliveries are handled by DHL and may be carried out by a local delivery partner, such as Evri, for the final part of the delivery. Depending on the delivery address, local delivery options and the carrier's delivery process, your order may be delivered to your home address, a parcel locker or a service point. The available delivery method may be determined by the carrier, and, in some cases, the final delivery method may therefore be selected without you actively choosing a specific option. Where permitted by the carrier's delivery arrangements and in accordance with your delivery preferences, the carrier may also deliver the order to a neighbour or leave it in a designated safe place. 

 

Our aim is to deliver within 4 to 6 working days from dispatch. Lead times may vary due to order volumes or circumstances beyond our control, such as carrier delays or customs processing. 

 

We do not send partial deliveries. When your order is dispatched, your card is charged for the products sent, and a delivery confirmation including a tracking ID is sent by email. 

We cannot make changes to the recipient or delivery address after the order has been placed. 

 

Damages during shipment 

 

If your order is damaged or lost in transit to you, ginatricot is responsible. Please notify our customer service as soon as reasonably possible. Where there is visible damage to the packaging or items that are missing, please notify us as soon as you become aware so that we can address the issue with the carrier. 

 

If products are damaged or lost when you return them, you are responsible for the loss. 

 

Uncollected packages 

 

If the products are not collected and are returned to us, we may charge a fee of £4,90 to cover the actual return shipping cost. This charge is communicated at checkout and applies in addition to any non-refundable original delivery cost. 

 

Return of products – right of withdrawal  

 

You have 14 days from the date you receive your order to exercise your right of withdrawal by registering your return at https://www.ginatricot.com/uk/returns. Once you have registered your return, you have a further 14 days to send the products back to us. 

 

You may handle the goods only to the extent necessary to establish their nature, characteristics and function, in the same way as you would be permitted to in a physical shop. You are responsible for any diminished value of the products resulting from handling beyond this. Where appropriate, a proportionate price reduction may be applied to your refund to reflect any diminished value. 

Once you have registered your return, you will receive an email with the relevant return instructions. Simply follow the instructions provided in the email to complete your return. You do not need to contact our Customer Service separately. 

When we have received and handled a return, the value of the products is repaid to you by the payment method that was used to make the purchase. We will refund you within 14 days of receiving the item back. 

 

The customer is responsible for the delivery cost exceeding standard delivery cost when returning the goods. 

 

ginatricot does not apply exchange of products – you can order new products via https://www.ginatricot.com/uk 

 

The following products are exempt from the right to withdrawal: gift cards, sealed underwear, sealed swimwear (where the hygiene seal has been removed), sealed cosmetics that have been unsealed, and pierced earrings for hygiene reasons. Returned shoes should be sent back in their original shoebox to avoid diminished value. 

 

Returns must be sent to the address shown on the return label: Gina Tricot’s warehouse, Segloravägen 6 504 64 Borås, Sweden. 

 

Defective product 

 

Products we supply must be of satisfactory quality, fit for purpose and as described. If a product is faulty or otherwise does not conform to the contract, you have the rights and remedies provided by UK consumer law. 

 

You generally have a 30-day short-term right to reject faulty products and receive a refund. After this period, you may be entitled to a repair or replacement. If repair or replacement is not possible, unsuccessful, or cannot be provided within a reasonable time and without significant inconvenience, you may be entitled to a price reduction or refund. 

 

If a fault becomes apparent within six months of delivery, it will be presumed to have been present at the time of delivery unless we can show otherwise.  

 

To make a claim, register the product at https://www.ginatricot.com/uk/returns, select the return reason for a faulty or defective product and follow the return instructions provided by email. There is no return charge for an approved claim. If the claim is not accepted following our assessment and you wish to have the product returned to you, a £10 return shipping and handling fee will apply. These statutory rights are in addition to, and do not affect, any other rights you may have under UK law.  

 

Personal data and cookies 

 

ginatricot is the data controller for the personal data you provide in connection with a purchase or when visiting our website. We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Reservations 

 

ginatricot accepts no liability for errors in illustrations or text on the website. We reserve the right to correct pricing or product information errors and to cancel an order prior to dispatch where an obvious error has occurred. This does not limit your statutory rights as a consumer. 

 

Disputes  

 

If you have a complaint, please contact our customer service first at CustomerserviceUK@ginatricot.com, and we will do our best to resolve the matter quickly and fairly. 

 

Customers in the UK may submit complaints to Consumer Arbitration. As a subscriber to Consumer Arbitration's services, ginatricot agrees to take part in its ADR (Alternative Dispute Resolution) procedure. 

 

Consumer Arbitration is approved by the CTSI to provide dispute resolution services and an independent assessment of your complaint under the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015.

Force majeure 

 

During an event of force majeure, ginatricot's obligations are suspended. If a force majeure event continues for more than 2 months, either party has the right to cancel the contract without any obligation to pay damages. 

 

Force majeure includes, but is not limited to, strikes affecting third parties, pandemics, transport disruptions, import/export restrictions, customs delays, natural disasters and acts of war or terrorism, whether occurring at ginatricot or at our suppliers or carriers.
